By accessing or using the Wishkr platform, website, and related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.

Wishkr reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

Wishkr is a curated gifting platform that facilitates the discovery, purchase, and delivery of gifts including but not limited to gift cards, flowers, cakes, chocolates, personalized items, and decorations. Wishkr acts as an intermediary between users and third-party gift vendors and delivery partners.

3. Eligibility

To use the Service, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement. By using the Service, you represent and warrant that you meet these requirements.

4. User Accounts

  • You are responsible for maintaining the confidentiality of your account information.
  • You agree to provide accurate and complete information when creating your account or interacting with the Service.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.

5. Orders and Payments

  • All prices listed on the Service are in Indian Rupees (INR) unless otherwise stated.
  • Prices are subject to change without prior notice.
  • Payment must be made at the time of placing an order through our approved payment methods.
  • Wishkr uses third-party payment processors. We do not store your payment card details.
  • An order confirmation does not guarantee delivery. We reserve the right to cancel orders in case of pricing errors, stock unavailability, or suspected fraud.

6. Gift Cards

  • Gift cards are subject to the terms and conditions of the respective issuing brand.
  • Once a gift card is delivered, Wishkr is not responsible for issues related to redemption, expiry, or brand-specific policies.
  • Gift cards are non-refundable once delivered.

7. Delivery

  • Delivery timelines are estimates and may vary depending on location, vendor availability, and other factors.
  • Digital products (gift cards) are typically delivered within minutes via email or the platform.
  • Physical products (flowers, cakes, etc.) are subject to vendor and logistics partner availability.
  • Wishkr is not liable for delays caused by force majeure events, incorrect delivery information, or third-party logistics issues.

8. Cancellations and Refunds

  • Cancellation requests must be made before the order is dispatched or processed.
  • Digital gift cards cannot be cancelled once delivered.
  • For physical gifts, cancellation and refund policies depend on the specific vendor and product.
  • Refunds, when applicable, will be processed within 7-14 business days to the original payment method.
  • Wishkr reserves the right to charge a cancellation fee for orders already in progress.

9. Communications

By using Wishkr, you consent to receiving communications from us, including but not limited to:

  • Order confirmations and delivery updates
  • Gift recommendations
  • Service updates and announcements

You may opt out of non-essential communications at any time by contacting our support team.

10. Intellectual Property

All content on the Wishkr platform, including but not limited to text, graphics, logos, icons, images, and software, is the property of Wishkr or its content suppliers and is protected by Indian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

11. User Conduct

You agree not to:

  • Use the Service for any unlawful or unauthorized purpose
  • Provide false or misleading information
  • Interfere with or disrupt the Service or its servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to send spam, unsolicited messages, or harmful content
  • Resell or commercially exploit any part of the Service without our consent

12. Limitation of Liability

To the maximum extent permitted by applicable law, Wishkr shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any information provided through the Service.

14. Indemnification

You agree to indemnify, defend, and hold harmless Wishkr, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any rights of another party.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
